The federal appeals court has maintained a prohibition on sending state troops in Portland, Oregon, following a latest legal decision.

Judicial Panel Concurs to Rehear Case

The ninth circuit court of appeals ruled on this week that it would reexamine the legal dispute concerning the executive power with an expanded group of 11 judges. The court also overturned a earlier ruling from a smaller judicial group that had sided with the federal government.

Legal Saga Over Troop Deployment

This legal directive represents the latest turn in a protracted court case over whether the former president has the legal right and valid reason to deploy state military units in Portland. Approximately 200 federalized guard members have been in uncertainty since late September when the mobilization attempt was initiated in due to months of protests.

Differing Viewpoints

The administration has argued that government employees at the ICE facility in south Portland were under attack, while city and state officials maintain that local officers have command of the situation.

In defiance of descriptions of Portland as “war ravaged”, locals have been posting videos of scenic paths and a thriving food scene, and planning events such as an protest bicycle event against the “militarization of our city”.

Recent Legal Actions

The appeals court decision came after a US district judge in the city issued two legal injunctions this month – one blocking the federalization of the state troops, and another stopping the deployment of any military personnel in the state, after efforts to circumvent the first order by calling up out-of-state forces.

On the previous day, the appeals court had put the first ruling on hold – permitting command of state troops – but the second ruling remained in place, blocking the actual deployment of the forces.

En Banc Review

The Tuesday decision means the matter will be heard “en banc” – with both rulings under review simultaneously – by a group of 11 judges.

“This ruling demonstrates that facts are important and that the courts are working to ensure government responsibility. The constitution restricts the executive authority, and Oregon’s communities cannot be treated as a testing site for expansive government power,” stated the legal representative in a statement.

“The judicial body is sending a definite signal: the executive leader cannot dispatch the military into American urban areas without cause. We will continue protecting Oregon’s laws, principles, and autonomy as this legal proceeding progresses and our legal battle continues in the courts.”
